A question - if, instead of POTUS fomenting an insurrection attempt it was the pres of Holiday Inn or MacDonalds who did the same thing with the same outcome, wouldn’t he or she now be in jail awaiting trial? If so, why should it be any different for Trump? (note: ignorant Cdn here…) ---

Because the Justice Department has a policy, which has been in force for decades, that they will not pursue charges against a sitting President (as such would distract him from his important job duties).
