A New IRS scam?

I don’t know if it is or it isn’t, but I’ll bet that fraud is illegal. It might even be illegal even if perpetrated against someone who is in another country. I doubt I can find anything about Indian law but I might be able to find out if the US outlaws the same sort of thing.

A friend of mine who is a partner in a law firm provided the following bit of info:

There is a large body of law regarding the extraterritorial application of US law. A rule of thumb is that if there is any nexus between the conduct and the US, the US can prosecute. So, a [similar] scam would be illegal here, even though you were defrauding someone in a foreign country, because the money would be taken in this country.

This, of course, is an opinion about a hypothetical situation and not legal advice to any individual, IANAL, he is not your lawyer, etc., etc.

Although this, of course, applies to US law and not Indian law, it would seem reasonable to think that India might also consider that activity illegal if it originated there. Anybody know any lawyers in India?
