If it can be proved that they were doing so, that would be a completely reasonable legal defense and the case _should_ be summarily tossed. The idea that the lawyers were arguing that Barrack missed his chance for a pardon is an insertion by the article author. I would recommend against reading the materials of an author who would do that, as it is subtly deceitful. ---

Unfortunately as I pointed out in a [different thread](https://boards.straightdope.com/t/new-stupid-republican-idea-of-the-day-part-2/959018/39), when it comes to the Presidential Records act, its up to the president himself to determine what constitutes a record that needs to be saved. 🙁 ---

My response would be to offer a wry smile and politely inform the defendant that he is certainly within his rights to request clemency from the current presidential office holder who I have no doubt will give it all of the consideration that it deserves. ---
