It happens, each jurisdiction has different requirements and it sometimes falls through the cracks. The federal civil system is particularly strict (I think you have only 10 days). However, to win a malpractice case you would have to establish that it probably would have made a difference in the outcome. That’s a tough burden. But not impossible. I wonder if Trump’s lawyers even have malpractice insurance. ---
