> Was that his plan all along? Get Trump’s lies on paper; then get Cohen’s truthful version. Perjury trap!

Somewhere along the way, Mueller figured out that Cohen was lying. Then he discovered that Cohen’s lawyers were talking to Trump’s lawyers, but nothing was said about this until Trump returned his answers on paper. Then he (Mueller) let it be known that Cohen had lied and the plea bargain was invalidated. Somewhere along the way, it was revealed that the lawyers had been talking.

I’m not a lawyer, but I don’t think there’s anything illegal about this. A bit sneaky and underhanded, perhaps, but not illegal. And a perjury trap is not illegal, either!

ETA: ThelmaLou’s link explains this much better than I just did!

There were dozens of lookups on some days and far fewer on others, but the total number was notable: between May and September, Alfa Bank looked up the Trump Organization’s domain more than two thousand times. “We were watching this happen in real time—it was like watching an airplane fly by,” Max said. “And we thought, Why the hell is a Russian bank communicating with a server that belongs to the Trump Organization, and at such a rate?”

[Here’s a pretty good article](https://www.theatlantic.com/politics/archive/2018/11/former-trump-aide-michael-cohen-admits-lying-congress/577003/) that concisely explains the significance of Cohen’s plea today. Some snippets that really helped me understand why this is a bigger deal than a typical run-of-the-mill Trump clusterfuck development. It makes a clear and easily understood case that Trump sold us out for the sake of buildiong one of his tacky hotels in Moscow.

> [@](#):
>
> The plea includes evidence, for the first time, that could show how Trump was compromised by Russia while Russian President Vladimir Putin was waging a direct attack on the 2016 election.
>
> \<snip\>
>
> Cohen admitted on Thursday that he lied to Congress about how often he and Trump had spoken about the deal in 2016, and acknowledged that he had tried to organize a trip for Trump to Russia in 2016 to scope out the potential project after Trump clinched the Republican nomination. He lied both to minimize Trump’s link to the Moscow project, and to limit “the ongoing Russia investigations,” according to Mueller’s team.
>
> \<snip\>
>
> That could prove to be incredibly damaging for Trump—who insisted both during and after the election that he had no business ties to Russia—and it could contextualize Trump’s consistent and inexplicable praise for Putin along the campaign trail. “This shows motive: Trump’s desire to pursue a major deal in Russia,” Jens David Ohlin, the Vice Dean of Cornell Law School, told me. “It finally gives Mueller some direct evidence that Trump’s associates continued to pursue business opportunities in Russia during the campaign, which would explain why Trump was, and continues to be, so deferential to Russia in general and Putin in particular. The motive was financial.”
>
> Cohen also appears to be in a position to corroborate a key portion of the Steele dossier—a collection of reports written by former British intelligence officer Christopher Steele outlining Trump’s alleged ties to Russia. Trump has called the dossier a collection of lies that was financed by Democrats.
>
> Steele’s sources in Russia claimed that “the Kremlin’s cultivation operation” of the candidate had included offers of “various lucrative real estate development deals in Russia.” While Trump had a “minimal investment profile in Russia,” the dossier continued, it was “not for want of trying. Trump’s previous efforts had included exploring the real estate sector in St. Petersburg as well as Moscow.”
>
> \<snip\>
>
> The project wasn’t revealed until August 2017, when The New York Times obtained emails between Cohen and the Russian-American businessman Felix Sater, who appears to be “individual 2” in the court documents filed on Thursday. Sater, who began advising the Trump Organization in the early 2000s and scoped out deals for the Trump Organization in Russia between 2005-2006, boasted of his ties to Putin in emails to Cohen in November 2015 and told Cohen that he could get “all of Putins team to buy in” on the Moscow deal. “Our boy can become president of the USA and we can engineer it,” Sater wrote. “I will get Putin on this program and we will get Donald elected.”

In the midst of the increasingly labyrinthine set of scandals, cons, and crimes in this administration, it’s refreshing to have nice, direct explanation of at least some of it. Trump wanted a hotel in Moscow. Putin wanted a nincompoop in the White House. Mueller can prove it.

[Here’s another good article](https://www.theatlantic.com/ideas/archive/2018/11/three-remarkable-things-about-michael-cohens-plea/577015/), this one from former Federal Prosecutor Ken White. White says the plea itself isn’t that significant to Cohen, but it’s a Big Fucking Deal because it “lays a marker”

> [@](#):
>
> Cohen already pled guilty in August to eight federal felonies, including tax fraud, bank fraud, and campaign finance violations. That plea already ended his career and exposed him to at least several years in federal prison. By contrast, Cohen’s new plea is to a lone count of lying to Congress in violation of Title 18, United States Code, Section 1001 – a weapon Mueller has wielded ruthlessly against President Trump’s followers including Michael Flynn, George Papadopoulos, Rick Gates, and Paul Manafort. **The conviction won’t increase Cohen’s sentence, and the additional felony count won’t have any perceptible impact on his life. If anything, by adding a cooperation term to his plea agreement, it gives him an opportunity to reduce his sentence.**
>
> Normally, federal prosecutors don’t waste time with this sort of rubble-bouncing. So why would Mueller spend the time and resources on it? Because it tells a story about Donald Trump and his campaign. Because it lays a marker.

(my bold)

White goes on to argue that Mueller is making his results public in court filings. Mueller has to deliver his final report to the AG, who gets to decide whether or not to make it public. Whitaker is likely to hold on to the report, but Mueller’s court filings don’t go through Whitaker. Mueller is “making his report” in stages. Similarly:

> [@](#):
>
> On Monday, Mueller accused Manafort of lying to investigators, breaching his cooperation agreement, and committing further federal crimes; he promised he’d bring the receipts when he filed briefs urging a long sentence. Those sentencing briefs will let Mueller tell the story about how Manafort lied about the Trump campaign—and by extension, lay out the evidence of what the Trump campaign did.

Both those articles are fascinating and not very long.

Really, all it means is that Team Trump lied about their Russian contacts.

That Trump wanted to build in Russia doesn’t mean that he did anything nefarious with the Russians, it just means that he wanted to make some money as a real estate developer. We would need to show that he did something **for** Russia in return for the real estate deal, to accuse him of criminal activity beyond lying.

Really? You don’t understand that Trump’s business dealings _are_ the basis for kompromat? The minute Trump lied to the American people saying that he had no dealings with Russia during the campaign, the Russians had him. They knew he was lying. That subjects Trump, and any of his family members who were also aware, to blackmail. That’s how kompromat works.

Now Buzzfeed shares that [Trump promised a 50 million dollar penthouse to Putin in exchange for being allowed to build Trump Tower Moscow](https://www.buzzfeednews.com/article/anthonycormier/the-trump-organization-planned-to-give-vladimir-putin-the). Do you think the American people were entitled to know about that before they cast their votes in 2016?

The big picture here is that Trump abandoned his oath to protect the American people in favor of furthering his own personal financial interests, and put himself in a position to be blackmailed by Russia in the process. Did it factor in to the change in the Republican platform to soften the American position toward the Russian invasion in Ukraine? The country shouldn’t have to even wonder if it did.

It’s not a bit of an “overstatement.”

It’s not incontrovertible proof, but it’s a strong inference. What Trump likely promised was to take a conciliatory stance on Russia, one example of that being the removal of support for Ukraine in the Republican platform. He may also have promised to weaken US commitment to NATO. We have no documentary evidence of a direct quid pro quo yet, but I’m starting to smell gun smoke.

Yes, that was a great article. The New Yorker is always a superb source of information, and usually way ahead of everyone else. Thanks for the reminder. 🙂

Let’s also not forget Jared Kushner’s efforts to set up a back channel line of communication with the Russians within the Russian embassy in Washington, or Erick Prince’s efforts to set up yet another back channel with Russia at his meeting in the Seychelles.

I mean, it’s _possible_ these people were setting up back channel lines of communication solely on behalf of themselves… but it sure is curious how they all seem to have one person in common. Along with so many others who were cavorting with Russians during the campaign and after.

It was all so innocent and routine that no one in the Trump camp could honestly speak of it for 2 years, despite constant questions about his relationship with Russians and Putin during the campaign and after.
