Uh, yeah. I got that the first time. My point, as I mull this further, is she should stop handling this as a real estate issue, and start treating him like a stalker instead.
In a past life, when I owned acreage, I had a neighbor who wanted me to give him a section of my property in exchange for relinquishing the easement right he had. I offered to exhange property acre for acre, but he he didn’t want that. I woke up one morning and found his son-in-law, marking various trees on my land with spray paint. After I confronted him with my shotgun and told him to get his ass off my land. He stuttered and stammered that they had a right of easement and intended to cut these trees down and move my barn over by 10 feet. I asked him where he got his law degree, and he said he didn’t. I told him that if he didn’t want to get a load of birdshot in his ass, he better contact my attorney before chopping any tree, painting any more trees, or attempting to move any of my out buildings. He was free to cross the property as defined by the easement, but that was it. I never heard from him again.

Thanks for the info. in #19 on the easements I will read them tomorrow. I will be back on line this week-end. I’m at a good friends house on their pc and appreciate all the responses and will read them again tomorrow.
I did call Legal Aid, but they don’t do property or real estate. I just cannot afford any attorney right now and will have to learn to defend myself.
Yeah VunderBob he did good on #22 also. I’m a woman that does Tile and Stone-Masonry by trade. I get a lot of respect in millionaires houses, but get NO respect up home. It’s just the mentality of some guys.
What if you talked to some of these clients you’ve done work for (in the millionaire’s houses)? Surely some of them are attorneys?
I don’t know your location, but have you tried going to your local town hall-- assessor’s office, etc,. They may be able to help give you some of the basic info
Most likely the Clerk and Recorder. But yeah, the OP needs the actual wording of the document, and who it is between.
The barn may very well be excluded (existing structures). If that’s the case, all the OP will need to do is dial 911 as soon as he tries to destruct your property. I’d do that reguardless.
Still trying to understand the way the land is laid out.
So, How Far Can They Go. You owned 9.705 acres. You purchased 10 more acres adjacent to your barn. During that deal, a 30 foot easement was added to the new outside boundary of your property that now included the 10 acres. But also, a 50’ easement was included between your original 9.7 acres and the 10 acres you bought. And it appears that your barn encroaches in this 50 foot easement?

I read her descriptions, and in my non-lawyered opinion, the easements are plain old right-of-way. In the general case, the old fart can cross her property, but he can’t possess the easements, nor make permanent modifications. If he wants to haul a trailer back and needs the room, HE has to restore the property afterwards.
BTW, there is nothing that says you can’t grant him onetime rights to use a different ROW than that easement if geologically feasible. He would then have to use land out of the way of the buildings.
You keep saying “The 50’ Proposed Easement”, you either have a easement on your deed or not.
With the easement if you block him he has the right to go to court and demand that you give him acess by the easement. It does not give him the right to come onto your property and clear it. If he trys to damage call the cops. You are going to need a lawyer either to stop him or to defend yourself.
By ‘proposed easement’, she means it exists, but nobody has exercised the right to use it since granted.
BTW, this is really a stalker problem, not real estate.

I fell off the map back four yrs ago. I finally went to court over bogus trespass charges after doing the right thing and getting the original surveyor back. This happening right about the time of this post. The neighbors called the law on me and the surveyor and three Walnut Cove Police came out and harassed me and the surveyor. Dean Slate of Slate Survey and I had left the area in question and then came three of Walnut Cove’s finest lol. The Sgt. Chad Williams went over to talk to neighbors and without talking to me, drives up to my driveway, pulls over and jumps out shaking his finger and firmly saying if he caught me back over there that he would arrest me. I kept trying to tell him it was the deeded 30’ Easement, but he kept telling that I DON’T TALK WHEN AN OFFICER OF THE LAW IS TALKING TO ME!
I kept trying to tell him this was the surveyor who split the farm and did the initial survey and that I had deeds to all the properties, plus my original survey, map and and aerial photo from the county. He would not listen to anything and jumped into his car as I called LLPP aka: Land L ss Prevention Project and spoke with one of their attorneys and told them I was currently getting harassed by three Walnut Choice Police. ALL I VIDEO RECORDED!!
Sgt. Chad Williams got out of his car and handed me a second trespass citation as I already had a pending court date on one the Wilkins’s had issued on me. They kept harassing me and didn’t even know where their property line and easement were! Johny Wilkins admitted it in court when I cross referenced him as I represented myself. I TRUST NO ATTORNEY IN STOKES TO REPRESENT ME!
Both bogus trespass charges were heard the same day after being put off a few times. The first time I walked into court and who was the court Bailiff but Christopher Nowlin???..the neighbor who harassed me, trespassed on my property previous, who I had spoken with Major Bennett and Captain Mike Marshall about. The punk told me he could come on my property any damn time he wanted to cause he worked with the Stokes County Sheriffs Dept. After a heated first conversation with this stranger, I found out from Sheriffs Dept that he was only a parttime jailer and that he didn’t work for the Sheriffs Dept. WTH?
I went in and spoke with then Captain Mike Marshall and said I wanted to press charges of harassment against their jailer Chris Nowlin.
