By an odd coincidence, it was in the AIM paint shop undergoing the Iron Patriot makeover when the invasion started. By the time it dried, they’d already nuked the Chitauri. ---

They kinda established in Iron Man 3 that The Iron Patriot is stuck with babysitting the President & Vice President. ---
