He was naughty and got punished according to the rules – booted out and had to finish the year elsewhere. Fair enough. But he later applied to a specialized program at a magnet academy within the same district and was denied admission. That’s the part that I thought was overkill.

Sorry, I should have made it clear. It’s the “expulsion” from a whole other academy that he hadn’t yet attended that I think is a little overkill-ish.

As for his parents suing for damages for his pain and suffering… :rolleyes:

You missed my point entirely. Its a matter for the courts, not the school. if it were on a school computer, it woudl be a school matter, its not, so it a criminal and civil matter.

The kid threatened classmates and teachers, it is therefore a school matter. A class bully who threatens a classmate, while walking home from school can be suspended even though the threat didn’t happen on school grounds. This situation was no different.

Please also recall that while the site was created on his computer, it is hosted on a server located somewhere other than his home. It is a public forum not a private conversation. In fact he (or more likely his parents) pay for the opportunity to broadcast his opinions. It therefore meets the legal definition of an advertisement.

Lets face it you don’t walk into an airport and joke about having a bomb. Threatening classmates or teachers with physical violence is not a joking matter either.

Has anyone seen the website? Is it obviously a joke? Is it obviously not a joke?

From the article it looks like he might have been a jerk, but probably wasn’t serious - if so, couldn’t they just say ‘get rid of the website, or else’? (Or maybe they did)
