Again (and again and again) NOBODY is claiming this shooting was not justified. This is not why the NYPD are assholes. They are assholes for running to cover their asses with the public by illegally obtaining and then releasing the medical records of the victim of a crime.

He was a victim of a crime and, although he did something stupid enough to get himself justifiably shot, he DID NOT BREAK ANY LAWS. But the NYPD did.

The article in today’s NY Newsday, while mentioning his drunken state, did not reference any specific BAC. Take that for what it is worth.

The problem, I think, Biggirl, is that you are seeing a NYPD conspiracy versus Officer Hernandez. More likely is that some officer found out the results and blabbed. You are applying your motives, not necessarily the motives involved. Try this scene:

At hospital, swarming with cops:
NY Post reporter, speaking to random NYPD officer: Was he drunk?
NYPD officer (not thinking in excitement): Yeah, he had a BAC of .10.

Next morning at roll call:
Desk sergeant, holding up Post: Which one of you nitwits said this? Idiots, keep your mouths shut.
NYPD officer: silence

Same result. No conspiracy. Equally as likely.

Officer Hernandez was the victim of a crime - the beatdown. There were, as of this morning’s paper, three arrests. Plus, as he should not have been armed, according to “Fitness for Duty”, it is quite possible he was breaking the law. (IANAL)

You are probably right D_odds. However, instead of calling it “looking for a conspiracy”, I’d call it “going on past evidence”.

The NYPD has a long history of releasing improperly releasing information in order to cover their asses.

And some NYers wonder why I look upon Rudy with such disdain. I remember the story (although I would never have remembered the name - good find and/or memory, Biggirl). That was business-as-usual for Emperor Rudy. I haven’t forgotten his pre-9/11/01 mayoring, especially his second term. I sure hope he doesn’t run for the U.S. Senate. I’d like to support the republican party against one of NY’s democratic senators, preferable Shumer. IMO, Senator Clinton is the lesser of two evils. [In my perfect NY, we’d have moderate Republican and a moderate Democratic representation in the Senate, not far left and even farther left]

I have to be at least a .25 before even considering a trip to White Castle; those 2 shots to the legs were more probably a lot more lethal than the slug into Hernandez’s cast iron stomach. Rumor has it the NY Post received a new leak on the officer’s blood tests: 285 mg HDL-Cholesterol and 380 mg LDL.

John, I haven’t tried any belly bombs since freshman year of college (where my average BAC hovered around .20). I’m amazed anyone can eat those things and live, regardless of BAC.

On a more serious note, the leg wounds were actually the more damaging shots. Both resulted in severe arterial bleeding. So much for people who say, “Couldn’t he just shoot him in the legs?”*

They had to amputate one of his legs…lower part.

Actually, if there is an ivestigation, a healthcare worker can release that information if he or she is presented with a subpoena. There’s nothing “standard” about having it show up in the paper the next day.

Sadly, Officer Hernandez has succumbed to the wounds he suffered. Six people have been arrested in the attack. Last night, one of the assailants’ shyster referred to his client as a ‘hero’ despite, as the newsperson pointed out, taking part in the assault without physical or any noticable verbal provocation from Officer Hernandez.

These six mooks who beat him may face murder charges, due to the fact that he may have died from brain injuries caused by the beating.

I read about it in the paper today. So sad. And I feel for the cop who shot him. He must be going through hell right now even though he did nothing wrong.
Just sad all around.
