‘Professional scammers’ refuse to leave Airbnb host’s house

Airbnb is a service where you rent out spare rooms to guests. In this case, the guests stayed for 30 days and now refuse to leave. In California, renters who occupy a property for more than 30 consecutive days are considered full-time tenants on a month-to-month lease with rights to occupancy protected under the state’s tenant law.

The original agreement was for a 44-day period but the scammers only paid for the first 30 days and then stopped paying. Why doesn’t that initial agreement of 44-days supersede the month-to-month conversion? Essentially, it seems they had a 44-day lease, which they broke by not paying. What’s to stop any California renter from swatting after the lease is up?
