Apparently they have some form of permission–I think they found some sort of loophole.
Here is there e-mail to me.

I guess that it is at least semi-legit.

So is this Doc, gay, straight, bi or neuter?
Curse you Philip Jose Farmer!!!
Well, I supose the question is: can you live with it?
That he actually anwered your email is good (and you’ve got a paper trail should this turn out to be illegal).
It appears that the case is closed!

He has claimed a right to publish, and listed the source.
I am satified, until something compelling persuades me otherwise.
I will order more volumes, as I believe there is a legal basis for publication.
Well, Bosda, you may be right after all. Here’s what David Moynihan, who runs Black Mask, had to say about the reprints on the alf.fan.doc-savage newsgroup, and frankly if he pulls this off I’ll consider it a victory for the Little Guy. I absolutely loath and despise Time-Warner and Disney for the way they’ve raped the copyright laws. (I’ve edited for length.)
When they cracked down earlier this year (all the “cease and desist”
missives that shut down the Shadowfan and whoever), they kinda left
two people off their lists. It’s my understanding that John Olsen,
who scanned in all of the Shadow over at spaceports, never received a
missive, but one was intended for him.
For me personally, I never got a letter. I’ve gotten other letters.
(I’ve been wrong on the status of works exactly once, and then I did
back down and apologize… quickly), so I contacted the rights agent
for Conde Nast, giving my current address, and hoping they’d let me
join the club. I also mentioned what I and some friends would do in
U.S. District Court, Southern District of NY, should such a mailing be
received …
I never got a letter, so to this day I still don’t know if they were
actual cease and desists sent out, or the infinitely more common “ooh,
scaries,” but we’re acting under the impression that it was the
former.
The Conde Nast rights agent has been informed that I’m reprinting the
series. I in fact provide them with ISBNs for each new volume …
We’ll see what happens. I am incorporated. They may become more
interested should the new Sky Captain movie (which to me looks very
cool) be succesful at the box office. We can perhaps talk licensing,
which I’d prefer to do … but I’m quite prepared for the alternative.
