There is indeed one view that the US constitutional system is overburdened with checks and balances.

It is indeed refreshing to see a solemn voice giving strident repudiation to the ‘due process’ model.

‘Sovereignty of the people,’ ‘consent of the governed’ ‘due process of law’, these sound quaint already, don’t they?

Are you suggesting that FDR’s conduct was reprehensible?

Sure, FDR did an end-run around a strict standard of “consent of the governed.” But in the end, he acted with the blessing of the US Congress. I’ve made a case that he bent a few laws, and told a few lies, to reach a very necessary goal. I don’t agree that this constitutes an endorsement of overthrowing our system of checks and balances.

But I can see where you might regard it as such.
