Beating a prostitution rap

I think if you’re dealing with someone who’ll do it for $20, getting busted is probably not the first thing to worry about.

Here in Minnesota, the statutes say that sex between any people who are not married to each other “whether for a consideration or not” is illegal.

So the whole question about ‘paying for it’ is moot. If you pay, they charge you with prostitution; if you don’t pay, they charge you with fornication. Not much difference in the end result.

Is the Minnesota law still operative in light of Lawrence v. Texas? I thought that pretty much struck down any law regulating consenting sex between adults in private that wasn’t prostitution.

So what about porn? Specifically “amateur” porn. (I’m sure the real thing exists, as well.) Why can’t the john just bring his camera along, hand over his $20, film the whole thing and put it online. Now he’s not a soliciter, he’s an entrepeneur. Or something.

It happens all of the time on certain sites like bangbus and 8thstreetlatinas, which show the guys pulling the girl over, handing her money, taking her in the car, etc. Is this illegal? Because they are taping the episode and putting the pictures and video on the internet for profit.

Are they paying for sex? Or paying for these ladies fine acting skills?

OK first, you know those sites aren’t real, right? You know that the people who’re being picked up aren’t just random people off the streets, yes?

As for the difference between porn and prostitution, what it comes down to is that porn performers are being paid to appear in a movie. The movie may involve performing sex acts but they aren’t being paid to perform those acts, any more than Chloe Sevigny was being paid to blow that icky director guy in The Brown Bunny.

I would beg to differ, as I have done business transactions with one of the guys that runs 8th Street Latinas (here in Miami area). They do arrange some of the things, for the pictures, i.e. having her pose with the money in her hand, etc. Some of the girls are repeats, and some get their friends involved. But some are girls they just pull of the street and offer them a couple of hundred dollars, etc.

And those girls just “happen” to be shaved, pierced, enema-ed for the anal scenes, have their HIV-free certificates, their birth certificates for the federal age regulations, etc.?

He’s lying to you.

Here’s the thing.

Pretending to make a porn movie is not a defense against a prostitution charge. You can come up with any convoluted story you like, and it all comes down to, “Will the jury believe this story?” And some porn producers HAVE been charged with solicitation, the reason not many are is that they tend to work in states and localities (ie, Southern California) where the local authorities don’t see much point in going after them. Try openly making porn movies in Macon Georgia and the local cops might have a different attitude.

The chances of getting busted for soliciting prostitution are very very low. The way most people get busted is through police stings. And your wink-wink-nudge-nudge stuff isn’t going to work very well. If you simply refrain from picking up streetwalkers you’ll avoid almost all danger of being busted. Phrasing your solicitation carefully doesn’t mean a thing unless the jury is brain dead. The real defense is that you’re not very likely to see a jury in the first place because there’s very little likelihood the police will even know about it.

Not to mention that those sites actually have a disclaimer on them (I am not going to copy it as I cannot get there from this computer) saying essentially, “This is fake, you would be very stupid to do this if it wasn’t fake.”

Once the undercover cop gets you to mention a dollar amount then the other cops swoop in.

So, don’t mention a dollar amount, ask which movie and what type of dinner she’d like.

When I was a high school student, a homeless guy stopped me on a dark street and recited a poem about raping a white bitch then doing time for it. Then he stepped forward within arm’s reach and asked me for all the money I could afford to help feed “a starving poet” and his kids. At the time, I wasn’t sure if I was being mugged or not, but felt intimidated enough to hand over the $2 I had.
