Can you be arrested and charged based solely on someone making an accusation of a crime

As if armed robbers can’t prevent a solo unarmed man from beating them up, they dispose some of their clothes while continuing to rob more people in the same hour.

I know two dudes falsely accused of hitting girls.

1 had a girlfriend say it, recant once she found out how bad out could be for him- but it was too late. He was arrested, is never allowed to own a gun, and was not allowed ro leave state for one year and for probation for one year (no dribbling). No physical evidence of him touching her.

Second dude had girl friend go nuts. She tried to extort him for thousands. He said no abs broke up. She then said he grabbed her wrist and hit her. No evidence at all. Later lied about hospital visits on record. He was arrested, never allowed to own gun (despite never being convicted of anything), was successfully extorted, and had restraining order she uses to keep him out of her town.

Sure it is. It’s not direct evidence, but the trier of fact can infer from your lack of alibi that you were wherever you are accused of being.

:rolleyes: I didn’t “beat them up”. I walked past them on my residential street on purpose in Boston because they looked really suspicious and out of place (it wasn’t an area where you typically see younger males walking around in dark hoodies at night). As I walked past them head-on, one of them slammed his shoulder into mine and then tried to grab me from behind while the other one was trying to open a knife while simultaneously demanding everything I had. I broke free, landed one very lucky punch and ripped down his hoodie before running as fast as I could away from them. The entire encounter took a few seconds at most and I was locked safely behind several layers of gates and doors and on the phone with 911 inside of my apartment within 90 seconds or so.

The police picked me up in the middle of the night after they brought an end to their spree and had them in custody. It was difficult but I was able to pass the photo lineup for both of them. That is when the police told me that they were happy that it worked out that I resisted but it was one of the dumbest things I could have done because of who we were dealing with. They explained their whole violent history and why it was important for them to go back to prison.

That kicked off the two year saga that led to both of them going back to prison. One plead guilty fairly quickly and got 3 years. The other wanted to fight it using a public defender so the process got drug out with multiple meetings with the police and Boston DA. Two years later, I was working in the yard of my new home 25 miles away from the scene of the crime when a car pulled up and some nicely dressed people asked me to confirm who I was and whether I had any knowledge of the crime. I still don’t know how they found me or knew that I would be home. It turned out they were associated with the defense and asked me to repeat the original photo lineup and confirm that I would still be willing to testify about it. I passed that lineup as well, gave an account consistent with the original one and indicated that I was going to testify if it went to trial. A couple of weeks later, the Boston DA’s office called to thank me for helping them reach a plea deal of 5 years for the second one. I was the only witness that would cooperate and it was all they had but they really wanted to get them off the street for at least as long as they could.
