Can the landlord refuse to rent to a person if they have a pet?

Yes, if a landlord has a “no pets” policy and they learn that a person applying to rent an apartment has a pet, the landlord may refuse to rent to that person.

The Residential Tenancies Act states that any clause in a lease that prohibits pets is void. This means that once a person becomes a tenant, if they have a pet even though the lease says pets are not allowed, the landlord cannot evict the tenant just for having the pet. However, the Landlord can apply to the Board to evict a tenant if the pet is causing a problem. My youngest cat, the adolescent Peanut, has one bizarrely amusing habit which I have not yet, alas, been able to capture by camera – though I’m trying.

He will sit up like a rabbit, straight up, front paws hanging at chest level, to get a better look at something above him or just because. So far, so normal.

He then stretches his paws over his head, looking up in their general direction, and briefly flaps them (often stretch-toed) as if he were batting at something just a bit beyond his nose.

Except there’s NOTHING THERE.

He does this pretty much every day. It’s like he has a piece of invisible string floating overhead and randomly enticing him to go for it.

Cats are weird.

My friend’s dog was snapping at imaginary insects in the air last night, so cats most certainly do not have a monopoly on weirdness.
