Similarly, cases from England from thirty years ago, pre-dating the Canadian Charter of Rights and Freedoms, do not determine whether Canadian courts will find criminal liability. .

Additionally, from the English viewpoint, constructive malice was abolished in England and Wales by the Homicide Act of 1957, which also got rid of the death penalty.
