>
> The federal government does not mandate the use of seatbelts. Since it has not prohibited regulations regarding seatbelts, it delegates that power to the states - all fifty of which have chosen to engage that authority to regulate it.
>
> In order to claim that seatbelt laws are unconstitutional, you must demonstrate that the US Constitution specifically forbids the states to pass laws regarding highway safety. At the rate you’re going, you’d be laughed out of the Supreme Court in about ten seconds.

The seat belt has nothing to do with it. They are enforcing a behavior that does not involve operating a vehicle or provide safety to others.

Please explain how wearing a seatbelt does not involve operating a vehicle or providing safety to others.

It’s self explanatory. It is not required to operate the car nor does it add any level of safety to those exposed to the actions of the driver.

you have yet to address what I said earlier about the Supreme Court’s position on personal risk as it applies to medical decisions. There is no specific law in the Constitution regarding this issue. The freedom to decide one’s own risk is implied.

Which means, per the Tenth Amendment, that the issue is delegated to the states.

again, which you seem incapable of responding to, I cited Supreme Court opinion regarding a person’s right to choose risk. It is an implied RIGHT.

If you don’t want to debate it that’s fine.

Pennsylvania has a DUI slogan: “you can’t afford it”.

I think the slogan and signage sucks. There _are_ people who can easily afford the legal fees involved in a first DUI offense. Should they therefore drive intoxicated?

Quite a lot of replies, even after I’ve already stated the thread was a stupid idea and I’m done with it. Certainly not reading them all. That said, after reading the first several posts, I’ve determined that these are probably the most popular arguments:

>
> You’re stupid.

Okay.

> [@](#):
>
> I don’t want to pay for the medical fees of people who get in car crashes while not wearing seatbelts

Okay. So they’re on their own. They assumed that risk when they chose not to wear a seatbelt. This shouldn’t bother you.

> [@](#):
>
> But I don’t like it when people die, and I’d readily accept any restriction as long as it saves a life.

Everybody dies. It’s not really a big deal. Besides, it’s not really your place, or anyone else’s, to dictate the lives of random people because you can’t bear to see them removed from the world.

> [@](#):
>
> _insert witty remark regarding my habit of not wearing a seatbelt here_

You are wrong. I always wear a seatbelt.

But they’re NOT on their own. I have never seen or heard of a medical provider, police person, or first responder deciding not to treat someone who did not wear a seat belt. Have you?

Your argument is, “I don’t like someone showing I’m wrong?” Really? That’s not a very persuasive argument.

I read every one of the responses. lots of them (like yours) did not address my point. The Supreme Court acknowledges an implied right to control one’s medical risk.

Does the Supreme Court acknowledge an implied right to endanger the lives of others by operating a vehicle in an unsafe manner?

And we’ve shown that not wearing a seatbelt poses a risk not only to the driver, but to others as well.
