Umm, the next Congress will convene on Jan 3, 2007. So, he won’t have to resign.

This actually makes some sense. House seats can’t be filled by appointment from the Governor. Thus, his district would be without representation.

It is cheaper for this slimeball to retain his salary than for his district to have a special election to fill a seat from now until Jan. 3, 2007.

Hey, he has to pay for rehab, too, you know. Isn’t that the drill? I did it. But it was the booze (or drugs or sex or whatever) and I’m gonna go to rehab and get all better.

Did you think you were joking?

Apparently, both parties agree that the first order of business in the lame-duck Congress will be to expel Ney. Good.

They wouldn’t have an election now; it’s too close. Neither is Foley’s seat having a special election.

Does anyone know the drill on that? Is it up to the state when to have an election to replace a resigning Representative or Senator?

Nope, there’ll be a lame-duck session starting November 9; [here](http://www.hillnews.com/thehill/export/TheHill/News/Frontpage/100406/pay.html)
and [here](http://timesofindia.indiatimes.com/articleshow/2052078.cms). It’ll be a perfect opportunity to eject Ney.

The Governor can appoint a Senator to serve until the next election. A represtentative can’t be appointed. A special election would have to be held
