> You are demanding action _now_. What action do _you_ think that they should take. What route do you see to codifying Roe v. Wade that they don’t that can be done before the mid-terms.

…you’ve quoted me stating that there isn’t a plan right now: and there isn’t one.

You’ve also quoted me asking somebody else if they are waiting until after the mid-terms before they do anything, what is the plan, and what is the agenda.

None of anything you quoted was a demand for action now to codify Roe v. Wade. I support AOC’s call for the administration to tell the American people what specific seats need to be focused on. What votes do they need, and where. And to tell the American people what Biden and congress will do if they win.

Okay, but voting rights are actually in the Constitution proper, and all of those rights are codified in federal law (mostly justified with Congress’s power to regulate interstate commerce).

H.R.3755, linked above, pointed to the Commerce Clause, the Fourteenth Amendment (sections 1 and 5), and the Necessary and Proper Clause as grounds for Congress to abrogate State police powers to prohibit abortions.

Fair enough, I take it back, you weren’t demanding anything, you were just complaining that what you wanted wasn’t being done.

Nah, if you are unaware of the attempts at passing Women’s Reproductive Health legislation, and the reasons that those attempts failed, and you are complaining about the Democrats like Biden, Pelosi, and Schumer, then you really have no clue what you are talking about.

…and you see this as a problem?

I’m not talking about “me” here.

I’m talking in general. Do you think that people should stop complaining about the Democrat leadership? Or is that something that you reserve just for me?

Because I’m seeing this in a lot of places, not just here. The sentiment that merely complaining about the leadership puts the election at risk. Is that something you feel is true?

I think you are painting with a very broad brush here. I don’t know why. Complaining about the Democrats like Biden, Pelosi, and Schumer doesn’t mean I don’t have a clue about what I’m talking about.

What am I, chopped liver? Speaker Pelosi moved multiple bills to codify abortion rights. I linked to the most recent example above. It’s the same one that **ISiddiqui** was talking about the Senate Democrats introducing in May, but didn’t have the votes to pass.

> Maybe possibly introducing a term limit plan (of staggered 18 year terms) isn’t really a plan.

Because it would require a _constitutional amendment_ and is therefore squarely not something Democrats can accomplish on their own, even if they wanted to.

Article III, Section 1 of the United States Constitution:

> The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour […]

Any statutory plan to limit the terms of Justices at the Supreme Court runs afoul of this provision, which states that Judges _shall **hold** their Offices during good Behaviour_ [sic].

Like for real, if they had the votes for that they would simply put the right to abortion in the Constitution itself.

So it really isn’t a plan then.

I suggest that the Democrats not only don’t have any plan, but that there are no _possible_ plans that could have been proposed after the 2020 election and before the 2022 election. Furthermore, unless the Democrats make significant gains in the 2022 election, there will be no _possible_ plans before 2024.

The word for this phenomenon is _gridlock_ (or _deadlock_).

…well the Republicans have a plan. And their plan is working really really well. They have control of SCOTUS. They will probably get the Senate at the midterms, and even a chance at the House.

So perhaps if the Republicans can make plans and execute plans then plans aren’t impossible? And maybe plans are good?

No. The system is inherently unfair and just because the Republicans can do something, does not mean the Democrats can. Democrats have no _possible_ plans. Republicans do. That is how it _is_.

Also it took the republicans and federalist society 40 years to accomplish this. Even with their structural advantages its not like they just set the abortion rights policy they wanted the moment they had a majority.
