Even if Obama got shot, I doubt Biden would be able to pass much legislation even if he invoked the memory twenty times a day.

Sure they did, or Obama did. But when every piece of legislation the Administration wants has to be (a) watered down and (b) fought for tooth-and-nail to get through Congress–and you can’t afford to anger any legislators by putting another federal prison among their constituents, you have to let that slide, pretty much. The OP is right in saying that the Dems never “took over” in 2008, at least if we mean truly left-leaning, non-Blue Dog Dems.
