Short story. Transgendered person wants license changed to reflect new gender. DMV clerk writes Fred Phelps like letter to the person. Wow. That woman sounds crazy! Sounds like she should have been fired after the first incident. Xians are funny. :rolleyes: I’m sure she thinks she’s going straight to heaven! ---

[This article](http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2010/12/11/BA0E1GP4M7.DTL) from the San Francisco Chronicle says that the DMV clerk’s name is Thomas Demartini and that he was suspended with pay pending an investigation. ---

The article makes the incident sound even worse. Demartini did something similar last year which spurred extra training, and this year not only did it again but had his church mail her a DVD! If, for whatever reason, he cannot be fired, he needs to be buried so far back in the bowels of the DMV that he will never see daylight again. ---

He certainly needs to be relieved of his access to the personal info he’s handing out to his church and using for his own purposes. I can’t believe he wasn’t fired months ago. ---

I’ve seen plenty of stories about fundamentalist doctors and nurses and pharmacists who want to be able to refuse their services because of their religious convictions. But DMV clerks!!!??? I don’t recall any biblical stories about drivers’ licenses. Can anyone remind me? ---

Oh man, this is too weird… I was gonna write up a joke list of 10 Commandments of driving, and atheist that I am I needed to look up the actual 10 commandments as a model. Low and behold, [there is a REAL ten commandments of driving,](http://en.wikipedia.org/wiki/Ten_Commandments_for_Drivers) issued by the Catholic church in 2007. ---

What data protection laws exist in the US? In the UK, our data protection laws exist to try to prevent this sort of thing. They should have been fired immediately for the theft of data, no second chances. ---

California has laws about theft and misuse personally identifiable information (PII), some of the strictest, as I recall, due to Richard Nixon and Hollywood. Outing transsexuals is specifically illegal and carries civil liability. His employer was particularly stupid for not firing him or supervising him well enough that he did not do this again. By allowing the idiot to do this a second time they made winning a lawsuit over this much, much easier. For me as an IT professional, revealing PII is the key offense here. I hope that fact is not lost in the noise about the extra dick move of outing someone. Using state gathered data to proselytize should get extra scrutiny. What if he had used his position to give the names and addresses to his church of all those whom he thought to be non-Christians? ---
