Enough witnesses need to testify before the grand jury to establish probable cause. This may, but does not have to, include confidential informants.

But if a CI does appear before the Grand Jury, can’t the accused attorny require that the state devulge his identity before they get to an actual trial court since it is now a matter of public record?
