My wife is an amateur photographer who takes her intellectual property rights very seriously. IIRC, she uses Flickr specifically because it enables her to maintain her copyright on any photos she uploads. I know she’d be furious if one of her pictures was used by the Trump campaign without permission, fair use or not. I can’t say whether Trump Jr’s usage would be considered “fair use”, since that’s very subjective. Regardless of whether or not it fits the legal definition of copyright infringement, it was a stupid move since it opens them up to litigation. Even if Kittos doesn’t sue, his statement still added another element to the story that further undermined the intended message. Think of all the trouble they could have avoided if they had used a stock photo website. ---
