You’ve never heard of deep pockets in tort law? Or an indigent defendant being judgment-proof?

Money or the lack of it may not affect your liability, but it sure as hell can affect whether or not someone will sue you, and the size of the judgment if you lose.

I think all these cases should be sorted out and put into actual law by legislatures, not decided as torts with common law precedents.
