Drunken Disorderly versus Public Intoxication

Yes, exactly. Well, with the one slight distinction that “drunken disorderly” makes sense and “one in the same” makes no sense. BOOM! ROASTED!

As far as the moderator getting involved over this; I’m flattered but puzzled. I think referring to my OP as “stupidity” was unnecessarily harsh and encourages disrespectful debate. Moreover, we do say “drunken disorderly” all the time in Michigan. I don’t care if no one believes me, or if you all think it’s a corruption of “drunk and disorderly.” It is not; cops say it, drunks say it, the papers write it.

This was my first OP here and thank you all for your feedback. It has been invaluable. Now that I am aware of the prickly sensibilities that abound if I use different words or expressions than some of you are used to, I will certainly never try to convince you what we call soft drinks here in Michigan. You’d never believe it.

Wow I knew cops in Texas love them some public intox charges, often totally spurious since the law only says appear to be intoxicated, but the numbers are shocking.

Thank you! Vindication! This is what I thought! Public Intox MEANS Public Intox! At least in some states. Now it makes sense to call them PI Laws! I certainly don’t think they’re just, but at least it’s not a universal misnomer (in the US, anyway) to use the phrase Public Intox rather than Drunken Disorderly, er, Drunk and Disorderly. (I’m trying to get back in the moderator’s good graces in the hope that this will be returned to General Questions.)

You need to read the whole thread before you start chirping. I clearly stated that we use “Drunken Disorderly” to describe a criminal charge. What kind of charge? A disorderly (charge). Any specific disorderly (charge)? Yes, a drunken disorderly (charge).

Similarly, I’ve seen cop shows where a line will be used such as, “Cagney and Lacey, get to 555 West 57th, there’s a domestic in progress!” Cagney and Lacey don’t respond, “A domestic what? You make no sense!” they know it’s a domestic assault. It’s understood. Cops are quick like that.

In the small town I grew up in it was a crime (a Miss Demeanor) to be in public unless you were intoxicated. That law has since been repeeled.

Disorderly is not a charge.

Disorderly is a fucking adjective, and therefor cannot be a fucking charge. Because you can’t be charged with performing a gods bedamned adjective.

There is no crime called ‘disorderly’, any more than there is one called ‘unlawful’.

The crime is ‘being a disorderly person’.

You can have a drunken, disorderly person. Or a person engaging in drunken, disorderly conduct.

You cannot, however, have drunken disorderly, because disorderly and drunken are both adjectives, and therefor drunken cannot modify disorderly.

Simple grammar.

Disorderly Conduct is kind of an all inclusive charge for someone being an ass in public. For this charge, there need not be alcohol involved as plenty of people find a way to be an ass without alcohol.

Many localities have both a public intoxication and drinking in public charge. Public intox is used when the person is not necessarily an ass, but is so drunk that they represent a danger to themselves. In the locale that I performed LE for, these people were often simply taken to county until they sobered up and were often released with no charge or released to a responsible person who agreed to care for the person. Drinking in public is a charge reserved for those persons simply drinking in an inappropriate location. I used this charge only for those cases where there was a complainant. For example, a local 7-11 has a license to sell alcohol, but no bar license and people were drinking on the premises. Since the 7-11 can lose their alcohol license, they complain, we roll up and if the drinkers refuse to dispose of anything open and leave, they get charged with drinking in public.

Lastly, drunk AND disorderly is a higher rated charge along the same level as disorderly conduct. This is your typical drunken ass. The difference is that you cannot be disorderly on your own property; that is a required element of the crime and thus, drunk and disorderly which you can commit on your own property.

When I worked LE, we had a vast range of discretion and it all boiled down to ONE thing. We called it the asshole tax. If I roll up and you are an asshole, then you are going to get charged with whatever you are guilty of with no leniency. If you are decent person and don’t act like an ass, off you go with no further action.

The last thing I wanted to do was deal with drunks. If I have to arrest you, that is 40 minutes to an hour that I have to transport your ass to county and then the requisite paperwork. I would just as soon avoid that, but if you force it because you are an ass, then I am going to make it worth the effort at your expense.

Well, no, I don’t. I used to say “illegal aliens” alternated with “illegal immigrants”, and now I exclusively use the latter phrase. I have never seriously used the phrase “an illegal” because it implies that the very person is illegal, as opposed to someone who merely took an illegal action.

Well there is that whole fighting ignorants thing.
