Employer says I can't get a second job

Sigene, it seems like your primary employers are not acting in good faith with you. It may be a good time – even if the situation with your teaching position shakes itself out – to consider whether or not this position is where you belong over the long term. It’s a little frightening to contemplate staying with a company that is making up their major policy issues as they go along, and creating documentation reactively instead of proactively.

Perhaps I phrased it badly. Sigene stated he’s been working overtime. He didn’t actually say whether he’s been getting paid overtime, but I seriously doubt it. It would be almost unheard of, for a startup company, and especially for a scientist. And, if he were, he probably wouldn’t need the second job; he could just work more hours at his first job.

If they have not been paying him for overtime, he is being handled in their accounting as exempt. Since it costs an employer nothing to carry an employee as exempt, but could, as you say, hurt them a great deal to treat one as such illegally, it can safely be assumed that he is exempt on their books. Any company, however small, that is sophisticated enough to have an employee handbook is bound to know these rules. In my opinion and experience, small (tiny) companies that have such a thing are generally run by scumbags who use it to squeeze the last drop out of their employees. It really serves no other purpose, when the company is that small.

The president of the company has been having a problem with this and has been making it hard on my boss…who in turn has felt compelled to carry out the presidents requests and concerns.

It turns out the president is worried that I’m going to leave the company because he thinks I’m getting paid $2000-$3000 per month at the part time teaching job…What’s up with that???If I were getting paid that much for a part time job…you bet I’d be gone. I’m more likely to leave because the president is a weasel.

Anyway, the president put in his last full day there and will be replaced by a new one on Monday…(This is absolutly unrelated to my topic and has been in the works for months…years even). The new president I was told looked at the mysterious appearing memo and after being appraised of my situations, reportedly said. “I don’t give a shit what the employees do on their off time, as long as they get their work done here.”

We all like the new president:)
