The Mein Kampf story is another copyright urban legend that has gained popularity on the Internet.
There is at least one other requirement – the trademark owner must continue to use the mark in commerce as a source identifier for goods or services. If you stop using a mark, other people are free to take it up. That’s one reason you might see old logos and brand names popping up occasionally (in “nostalgia” ad campaigns, and such).
There’s an interesting story in Slate about George Lucas allowing fans to make and distribute Star Wars media (in this case movies, specifically the one in the article which cost only $20,000 to make) if they aren’t making a profit.
Or maybe doing this (without profit) is legal anyway. Maybe one of those law-talking-guys will clarify.
