You’re probably right on double jeopardy, but Smith will have to appeal, get this reversed, and then it would be remanded back to Judge Cannon. The government can ask that it be reassigned to a different judge, but that would be an unusual ruling by the Court of Appeals (justified, in my opinion, but unlikely). ---

No jeopardy, which is nice, but it’s been delayed enough such that nothing will happen before November. He will likely wriggle away. ---

This case should have been the slam dunk, open and shut, easy peasy case that was heard and adjudicated last year. The facts were easy to understand and pretty hard to argue against. I am infuriated. I haven’t attempted to understand the arguments about the appointment issue, but I will say it seems ironic that a special counsel is appointed for Trump’s protection, to remove “Biden’s Justice Department” from the prosecution, and it bites them in the ass. ---

My position was recently the subject of a SCt decision (Lucia 138 SCt 2044) holding us to be “inferior officers.” Struck me to be a bullshit argument/decision then, as it does now. Don’t be so certain that the Supremes will overturn Loose Cannon. ---

I’m guessing Cannon wanted to dismiss this case while the news was still mainly covering the shooting in Pennsylvania, so as to get minimal attention. ---

thomas did tip his hand regarding special councels. cannon is saying jack smith is not authorized to conduct the prosecution. as i understand it there are 2 ways to go. 1. appeal to 11th circuit. 2. refile with a different prosecutor. of course 3. just give up is not an option. what a few days it has been in the usa. ---
