He’s the one creating the delays. He shouldn’t be rewarded for that. I feel like your hangup is that people are charged with the espionage act without actually doing anything that you consider espionage. Espionage Act violations, without real espionage, seem to me more a reason to fire an employee (or not vote for a candidate) than to jail them.
