What is our legal authority for going into Pakistan? Does the AUMF authorize military force somehow generally, where needed, rather than in specific nations?

It’s called proactive self presevation and not waiting around with your thumb up your ass while someone is preparing to attack you. Pakistan has nukes, if they were really pissed and didn’t want us killing these guys they could make us stop just by threating to retaliate; but you see they don’t.

In the past, the legal justification has been that hot pursuit of fleeing enemy forces was part of the inherent right of self-defense. Since the border isn’t really clearly delineated in the first place in many places, it wouldn’t take much for an aircraft to go a few miles into Pakistani territory/airspace and not immediately realize it.

The link that your cited article uses to support this claim doesn’t work. Given that even the Pakistani military can’t or won’t reach these areas to maintain order, it’s hard to believe these estimates of civilian casualties. Particularly since the Taliban intentionally blur the line between civilians and combatants by refusing to wear uniforms, as well as blending in and hiding among the civilian population before, during, and after their attacks.

The fun part of guerrilla or asymmetrical warfare is that you’re fighting civilians.

We get to continue “hot pursuit”, they get to denounce it so they won’t have to watch their political career go down the toilet. And the bad guy gets caught. Eventually it is forgotten. It looks like a fair trade to me.

Yes, it’s obvious that there is an understanding between us and Pakistan to allow targeting across the border. Could you see us doing this with any other nuclear power and getting away with it? And since we don’t have a lot of good intel on that side of the border its not a stretch to assume that the Pakistani government is pointing them out to us in quite a few instances. Of course that’s probably just the AmeroConned sheeple in me talking. :rolleyes:

When you Pakistanis have a massive flood or you Hatians have a catastrphic earthquake…any time anyone has any disaster, the US of A is always the first one to respond to help and always offers up the most (by far) in financial resources and aide, and yet, you all still hate us.

Not possible for us to pull out as long as we have forces in Afghanistan, a completely landlocked nation. Once we’re out of there, we’re free to go tell the Pakistanis to go fuck themselves with the Devil of their own creation.

The hot pursuit doctrine in international law is sufficiently fuzzy that Pakistan’s consent is arguably irrelevant when pursuing non-state actors operating out of Pakistani territory and not prevented from doing so by the Pakistani government.

Ghu forbid that pressure tactics should be applied to force them to meet their obligations under international law. :rolleyes:
