Again, check the lease. In any place that I let, _any_ illegal activity is reason for eviction. And recreational pot use in NY is still illegal. As an owner, I’d have the property manager enforce the lease in a NY minute. That smell and the residue are hell to get out, and the longer they’re in there, the harder and more expensive it gets. Cigarette smoke too, but that’s harder to evict. Better sooner than later, as winter evictions in NY are near-impossible regardless the reason. ---

I have to wonder what leads the OP to the conclusion that Stoner Guy is dealing? Shoot, he may not even be buying from a dealer (nice houseplants, anyone?). As others have posted, use within guidelines isn’t a criminal offense. ---

There not going to go through the hassle of filing an eviction in court over a over some dude smoking pot. If they did that, they’d lose 40% of their tenants. ---

FWIW, I moved into (what I consider) a luxury apartment complex. I used to smoke weed, but the lease here explicitly prohibits it (even though it could technically be construed as legal otherwise). I took a few tokes here under the “go in the bathroom, turn on the fan” system. But I felt guilty. I looked around at where I am, who I am living with, what I make at the job where I could potentially get in trouble… and I quit. I don’t smoke weed here, it is against the rules. I haven’t had a single toke in months, here or elsewhere. I can look my neighbors in the eye. I gave it up. Nobody confronted me. That said, I recommend the OP communicate with the guy in person or via note before going to the authorities. Pot doesn’t really matter much- there is probably something the guy can do to keep the smell out of **Cartooniverse** ’s place if he just asks nicely. ---
