To be clear, astorian, Abe Fortas was nominated for Chief Justice, but was not confirmed by the Senate and then resigned. Clement Haynsworth and G. Harold Carswell were nominated to his then-vacant seat as an Associate Justice, not as Chief Justice, and neither was confirmed. Warren Burger was nominated for and confirmed as Chief Justice, and directly replaced Earl Warren in that post.
