Who here follows Glenn Kirschner on U-tube or wherever? Well, Bryan Tyler Cohen went there: He asks Kirschner if he would like to be Attorney General in a future Dem Admin. They are discussing the possibility that DOJ officials could be prosecuted for conspiracy and a plethora of other crimes, should a suitably inclined administration ever be in power again. I haven’t kept track of him recently, but I’ve always thought Kirschner was an intelligent, forthright person. He also has a gift for explaining complex issues in understandable ways. He’s young enough and if he wants it, we could do a whole lot worse. ---

According to the video, lack of law enforcement over Watergate explains corruption in Trump administrations. Wrong. Many of Nixon’s underlings, up to and including his attorney general, went to prison. Does anyone think that Pam Bondi is staying up nights making sure she isn’t doing the same thing John Mitchell did? I don’t. She may be worried about whether a case against Barack Obama would have jury appeal, but not about the Mitchell precedent. Similarly, Trump is not figuring that since Nixon avoided being convicted, he himself has nothing to worry about. For one thing, Trump was himself convicted! Is that making him any more law abiding in his second administration? Of course not. It’s just making him more determined that the GOP doesn’t lose control of the government going forward. Another kind of example is the pattern of repeated arrests and convictions, over decades, of New Jersey politicians, [as described here](https://us.macmillan.com/books/9781250001931/thejerseysting/). Robert Menendez lived through several such cycles and it did not deter him. Assuming Trump cannot fully consolidate dictatorial power, it’s now inevitable that there will be a cycle where top Republicans arrest top Democrats and vice versa. While I’m in favor of non-partisan public corruption units, they aren’t the solution to what ails us. ---

On the other hand, nobody involved in the Iran-Contra Affair under Reagan ever served time, even those who were actually convicted thanks to pardons, refusal to prosecute, and being given immunity (Oliver North). The only person to serve time over that entire scandal was Bill Breeden (a former religious minister) for stealing a street sign for a street that had been renamed for John Poindexter. So, it would seem that for all practical purposes, “When the President does it, it’s not illegal,” long before the Supreme Court formally established this as a judgement. Trump is not going to be held accountable for anything, and it seems unlikely that anyone else in the regime will, either, because nobody wants the precedent of being held legally accountable for after the fact for following ‘questionable’ policies. Glenn Kirschner: Retired Federal prosecutor in D.C. of 30-some years. Military JAG for several years before that. Now, political and legal commentator. Vehemently critical of all things Trumpish. Has U-tube channel “Justice Matters” with nearly-daily videos. Also appears regularly with Brian Tyler Cohen. Highly recommend his videos. Obviously profoundly qualified for Attorney General job. And clearly likely to be aggressive kick-ass AG in chasing down Trump and sycophants. ---

I can imagine the DOJ breathing a collective sigh of relief were he to replace Bondi. I personally don’t like that he used to prosecute death penalty cases, but I like him anyway. ---

While I would say that ordering Seal Team 6 to get Bin Laden would not be murder. Trying to overthrow the USA is a bit of a high bar. We cannot have a rule written down for every single type of crime or injustice. That’s why we have judges.
