You know what? If you’re happy believing that the gay panic defense is alive and well and living at the Araujo trial, more power to you. Said belief flies in the face of the published news accounts, which seem to indicate that the jury hung over the terms of legal art, but you go right on believing it. Me, I’ll believe that the failure to convict on manslaughter along with the jury poll indicating they were split between murder one and murder two is a sign that the jury didn’t buy it and it’s another nail in the defense’s coffin.

Otto: why are you miffed at me for raising the question that perhaps ---- just maybe! – the defense arguments impacted the jury’s deliberations? I know it’s a stretch, but it really has happened before.

Do you really think the DA’s spin – plus a very select survey of a couple of jurors --conveys what really happened in the jury deliberations? I’m willing to concede that that’s indeed the case, but unwilling to not examine other alternatives, at least until we have more information.
