Does anyone know how many pregnancies end up with the child being put up for adoption? What percentage is it? Of those that end with adoption, what percentage of them are done so without the father knowing? Now of all those cases, how many of the fathers really give a shit enough to actually take on raising the child on their own?
Chances are if a man can’t be bothered to stick around a few weeks after he’s had sex with a woman, he really doesn’t want to be bothered to stick around for a child.

You want a specific cite that a hospital can’t tell a man that woman had his baby? A hospital can’t tell anybody anything, dude. There isn’t a specific line that says “you can’t tell a dude that a woman had a baby,” the laws prevent any disclosure of information without permission from the patient or under specific conditions. There is no exception in the law for a dude that might be a father of some patient’s baby.

This would be an extremely stupid practice anyway. Hospitals are not fucking detective agencies. Their job is to treat the patient and that’s it. How would they even know that a father was out of the loop? What if the patient refuses to disclose any information? What are they supposed to do, arrest her?

ShadiRoxan-

Why are you blaming it on the man for not sticking around? How much effort does he have to exert? If she moves across the country does he have to follow her? If she breaks up with him and tells him to get lost should he track her down 8 months later and pat her belly? What if she lies to the man?

Again with the “moving across the country.”
Yes, the country is full of women who are secretly getting pregnant and moving across the country.

You don’t have to give any information about the mother of the child. Call dad and tell him his child was born at X hospital he needs to do Y to get custody. No mention of the mother or her medical history.

Even if it could be construed to violate the mothers medical history so fucking what? She has just been walking around with a giant belly for the last 2 months and will have a kid with her for the next 18 years. Its not exactly a secret that she was pregnant. Doesn’t the kids right to have a father in his right supercede the mother’s rights?

On preview:

Do you think women abstain from sex 9 months before they move? And what about the rest of the scenarios? Do men need to become stalkers for 9 months after they have sex?

Thats generally what happens when you break a law.

Illegal and not the hospital’s job and you didn’t answer the question about how the hospital would know who the father was or know that the father didn’t know about the pregnancy.

There is no such legal “right” for a child to have a legal father.

I don’t believe that they keep their pregnancies a secret from the fathers…and if they do, there’s probably a pretty good reason.

They don’t have to stalk a woman to simply keep in touch with her or be available for her phone calls.

Fine let DFSS take care of it then.

If the father isn’t at the hospital that might be a good indication.

You’re asking a bunch of hypotheticals that go against the norm of what happens in reality.

I’d guess that a majority of the people in this situation are young and/or uneducated. They probably don’t have the means to pick up and go. I personally don’t think that a man should have to try to track down every woman he sleeps with several months after the fact just to check and make sure. But then again I also think that people, both men and women, shouldn’t be fucking random people that they have no intentions of keeping some form of contact with long enough to know the outcome.

[HIPAA](http://www.hhs.gov/ocr/hipaa/).

Medical privacy laws were recently altered and are pretty strict. Scary strict. You can’t tell anyone _anything_. When they switched over to HIPAA recently, a lot of things changed. **Diogenes** probably had special training at his job, as did I. Very serious business, HIPAA.

Hospitals are not in the business of telling third parties about who is in the hospital, who is seeking treatment, and so forth. Doesn’t sound very HIPAA-complaint to me.

I did get the HIPAA training and you’re right, it’s almost scary how careful you have to be. Technically, I can’t even tell my wife what my clients’ names or diagnoses are.

Whats illegal about it? We aren’t revealing anything about the mother at all to anyone. Doctor says ‘Under X law you are required to give information about the father of the child’. Doctor calls up DFSS and says Man X’s child was born at the hospital. DFSS (Department of Family and Social Services) calls up Man X and says your child was born at Hospital Z you need to do X Y and Z to claim custody of your child.

Then the woman would say Man X is the father you can reach him at this number. DFSS calls the man and he says yes I know and its finished up. Not 20 minutes of effort.

The law I am proposing.

I certainly hope it wouldn’t come to that. All I want is a name, a phone number an adress anything. If she continues to refuse then take her baby away and throw her in the slammer. She doesn’t get to break laws just becuase shes a new mommy.
ShadiRoxan- I know these situations don’t normally happen. Why don’t we have a law saying that DFSS should make a reasonable attempt to inform the father that he has a child? We should be doing this anyways to make them pay child support. I just want to prevent a situation where the mother claims child support years after the birth and the father is blind sided.

It would be a violation of HIPAA, as has been pointed out. Trust me on that, ok.

And Social Service Departments do not track down fathers. That’s not their job. They provide services to families who need them. They are not detective agencies and furthermore, the hospital is not allowed to reveal medical info even to a government agency.

Mosre often than not. If she isn’t calling him there’s probably a reason. Women dodn’t keep pregnancies secret from fathers for no reason at all.

You don’t know shit about social services. Like I said, Social Service Departments are not equipped to do that and the hospital is not allowed to inform them of anything anyway…and it’s nobody’s motherfucking business who the father is. The woman doesn’t have to say shit and hospitals don’t have the time or ability to act out your misogynistic fantasies for you.

Well: [http://www.hhs.gov/ocr/hipaa/links.html](http://www.hhs.gov/ocr/hipaa/links.html)

Summation: Historically, states have at times gone to court to establish paternity, to recoup costs of child support and medical costs, including costs of the actual birth. The federal government is now discouraging this because it doesn’t seem to help. Most of these are low-income people without any money to give anyway. They’ve decided dragging the woman to court and estranging the father is counter productive.

I doubt they would actually imprison somebody in those situations. What would happen is that the mother would be refused aid. Another reason not to bother. It just punishes the mother (and child) for protecting a deadbeat.

And correct me if I’m reading this wrong, but… are you asking why women should get away with breaking laws that don’t exist?

I think reflection on the unhappy realities of such a law and ramifications of its practice would show why The Cynic has reacted so strongly to its suggestion.
