The vandalized homeowner may also file a claim and his insurance might pay out initially, provided the policy covers vandalism. But if he chooses to go this route, his insurance company would pursue reimbursement against the insurance companies of the parents of the vandals (in a process called subrogation) because the parents are legally and/or civilly liable for the damages. *Their *homeowner’s policies would ultimately be responsible for paying out, in the form of a **homeowner’s liability **claim (well, maybe as many as 4 claims). The victim’s rates might go up if he does this, because filing a claim increases the risk that one will file future claims, regardless of fault. But his rates wouldn’t go up because somebody else damaged his home. If he chose to directly pursue the insurers of the parents instead of filing a claim with his own carrier, his own rates would not likely be affected.
Oh, and insurance does not only cover damages that the policyholder cannot afford to pay out-of-pocket. Insurance covers any and all damages that exceed one’s deductible. Rich celebrities can and do still carry insurance and file insurance claims. Although a rich person would potentially carry higher deductibles, because it lowers their rates and they can afford it.
The owners can get paid quickly from their homeowners policy, and still go after the kids’ parents, as can the insurance company sometimes, or the owners may be required to sue. The owners can collect anything the insurance doesn’t cover from the parents, and all of it if they can, but they’d have to refund the insurance company anything over their out of pocket costs.
That’s the way it works. There’s nothing wrong with it, that’s why you get homeowners insurance, which usually contains a general liability policy, which may be where the parents get any money to pay damages from.
