Also an amazing idea I’ve seen suggested: Biden steps down now. Harris becomes 47th President and does a bunch of popular stuff. Then the MAGA folks have to spend time getting rid of the popular stuff, and all of Trump’s 47 merch is no good. ---

He’s already hurting from being a one-term President and he’d never agree to be a less-than-one-term President. Too cutesy by half, anyway. A majority of American voters, much as it pains me to admit it, have said they don’t want Kamala Harris to be President. To make her one now, even if just for a few months or weeks? I don’t think so. There’s nothing stopping Biden from doing the same “bunch of popular stuff” now if he wanted to. ---

Top of my list, I think: starting the process—one with long historic precedent—of making the number of SCOTUS Justices the same as the number of US Courts of Appeals. The number of days between the death of Ruth Bader Ginsburg and the assumption of office of Any Coney Barrett: 39. (18 September to 27 October, 2020.) Biden has, as of today, 70 days. He could do it. It has historical precedent (reconciling the number of Justices to the number of Courts of Appeals). But I suspect he’s too…you know. And that pisses me off about Trump. (Good save?) ---

Manchin has generally been good on judicial appointments but on something like a precedent setting (and I don’t think he’d be convinced by the Court of Appeals argument as being precedent) change to the number of SCOTUS justices, he’s been less reliable. And Sinema can be counted on to do whatever keeps Sinema in the spotlight, which does not exactly build confidence. While this sort of plan _might_ work, it could also more easily be remembered as a closing failure in an otherwise largely successful term in office, albeit one already marred by that election.
