Yeah. Just like “other people’s money”, he spent other people’s lives.

I was thinking Felony Murder. 6 counts. It was 6 who died from the failed putsch?

Trump might’ve stirred the group up, but every one of those Capitol-invading individuals chose to be there and to do what they did. The person who does a bad deed is the one who did it, and is responsible for her or his own actions.

Conspiracy is probably not the model you want, though. Solicitation and incitement are a slightly different offense to conspiracy in most jurisdictions.

In your second scenario, “insist[ing] that it would be justice if people marched to the bank and forced them to give back their ill-gotten gains” sounds an awful lot like solicitation or incitement to me. There are different formulations in different jurisdictions about what kinds of crimes qualify, and how the solicitation is treated procedurally, but whereas with conspiracy you have taken steps in furtherance of the crime itself, with solicitation or incitement you’re just trying to persuade someone else to do a crime. They often don’t even have to do it, and you don’t have to help them do it in any way, you just have to want them to do it, and try to get them to do it, and that can be criminal behavior.

Just to pick two jurisdictions out of a hat, under federal law, solicitation is when someone

> with intent that another person engage in conduct constituting a felony that has as an element the use, attempted use, or threatened use of physical force against property or against the person of another in violation of the laws of the United States, and under circumstances strongly corroborative of that intent, solicits, commands, induces, or otherwise endeavors to persuade such other person to engage in such conduct

so solicitation of robbing a bank under federal jurisdiction sounds like a decent case to me.

In Washington DC,

> In prosecutions for any criminal offense all persons advising, inciting, or conniving at the offense, or aiding or abetting the principal offender, shall be charged as principals

so if you incited someone to rob the bank, you could be charged with actual bank robbery in DC.

Maybe that’s something Jack Smith is looking into.

However, nobody would had bother to be there if Trump would had accepted defeat and congratulated the winner, and offered to help the new president…

As it was usually done.

> **[Gore concedes presidential race after the fight of his life](https://www.theguardian.com/world/2000/dec/14/uselections2000.usa12)**

> Democrat Al Gore surrendered his battle for the White House, accepting Republican George W Bush as the 43rd president of the United States. "I accept the finality of this outcome," the vice president said.

> “Now the US Supreme Court has spoken. Let there be no doubt,” Gore said. “While I strongly disagree with the court’s position, I accept it.”
>
> **He called for his supporters to unite behind his Republican rival Bush. “We close ranks when the contest is done,” Gore said.**
>
> **“While we yet hold - and do not yield - our opposing beliefs, there is a higher duty than the one we owe to political party. This is America and we put country before party,” Gore said. “We will stand together behind our new president.”**

Yeah, but all the invaders were individuals who chose to do what they did. Nobody made any of them do what they did, except themselves. Any of them including the one who was killed could’ve said to him- or herself, “Fuck this for a game oif soldiers, I’m going to go home and enjoy a calzone”, and gone home to enjoy a calzone, but they didn’t. Idon’t like or respect Trump (or any other president for that matter), either, but he didn’t make anyone do jackshit, it was their own decisions and their actions.

Uh, what that reply gets wrong is that it should not be a “but”, it should be an “and”.

Just punishing the low level gangsters and leaving the crime boss off the hook, is not a good way to deal with crime and corruption. **And** , nowhere do I propose that the grunts should be let go just because they “followed orders”.

BTW, in context you are also implying hard that past presidents or candidates that advised their followers to accept defeat and unite behind the new president don’t deserve any respect, that is a very stupid thing to say for reasons that should be obvious by now.

Frankly, I think the charge should be Felony Murder (2nd degree). One count for every person who died on Jan 6 at the Capitol, regardless of which side they were on.

There is actual evidence of real crimes that Trump has committed, crimes that should land him in prison for the rest of his life if our justice system really did treat everyone equally as it is supposed to.

Lamenting that he isn’t being convicted of crimes that there’s no evidence he committed is just an exercise in frustration.

Let me add, if we want to make stuff up, I’m in favor of convicting Trump of deliberately trying to destroy democracy in the country, and sentence him to a lifetime of public service. And that public service will consist of waking up early every morning, having a bucket of honey dumped on him followed by a bag of yellow feathers. Then make him pick up trash along the side of a busy roadway for 8 hours, with just one hamberder break for a half hour in the middle of it. (No ketchup though.) He will make himself useful by cleaning up the road, and also be something people can point and laugh at as they drive past.

That’s a point that I wish the Harris campaign would emphasize more. Trump’s stupidity and denial put millions of people’s lives at risk, and many of them perished.
