Thought I’d throw this in. I found a free site called 12Law where you can draft your own will without needing an attorney. The forms are written with your state in mind. In the case of MN, all that’s required are two unrelated witnesses and a notary. You can also designate an executor. The site gets excellent reviews.
From the testators or the executors?
I know it’s a bit late for the OP, but I’d even go so far as to say that the proper thing for an attorney to do, when a husband and wife pair come in to talk about the husband’s will, would be to invite (insist) the wife to step outside. And vice versa.
It’s a confidentiality issue. Never mind spousal privilege. It’s a simple matter of who the client is, and making sure the client gets candid advice or at least an opportunity to first make an informed decision on whether they really want their spouse present.
The folly isn’t going into a joint meeting unprepared, it’s going into a joint meeting period. And a good attorney should see it coming and nip it in the bud.
