This one I don’t agree with you on. You do indeed point out what the lawsuit is for, but you point out the facts of the situation, not how those facts would be looked upon by the law. It’s “This is what happened, so the cop was wrong.” not “This is what happened, here’s how those facts should be interpreted legally/in court, so the cop was wrong.”

This is what happened:

… what this cop did: radio for a fellow officer to stop the photographer for no good reason, then confiscate the smart card on the digital camera and erase the images.

This is how those facts give rise to a cause of action:

The photographer is suing the city for $25,000, saying his civil rights were violated.

This is my indication that in my view those facts support that cause of action:

I’m usually a defender of the cops, even if, in hindsight, they didn’t choose the absolute best course, because I do think they need some leeway when they’re in high-pressure situations.

This doesn’t come close.
