The setting of International waters is relevant, because the Pirate Flag is totally legal in U.S. waters, where the First Amendment holds sway. What rule/law/regulation “outside United States waters” prohibits merely flying the so-called “Jolly Roger”? AFAIK, piracy is determined by actions, not by displaying what is essentially a memento. ---
