I think Saint Cad is talking about Katherine Harris, then the Florida SoS.
Yes I was.
Laws must be in place before election day so what if the law is in the process being appealed
On election day?
On the day early voting starts?
But that’s going to be a worry for the next election. This one is only two weeks away, the appeal can’t happen that fast.
My WAG is that whatever happens during this election will factor into that appeal.
Nothing, that law isn’t in effect specifically so that it doesn’t interfere with this election.
They tried and failed to screw up this election and have to set their sights on future ones.
Yeah there is no chance of it reaching SCOTUS though its being expedited directly to the Georgia supreme court. So it’s conceivable IF they want to hear the case then they could rush it through maybe? I’ve no idea what the make up of that court is. If it’s as MAGA as the SCOTUS currently is you could imagine they could put a stay on the lower court ruling while they hear the case, which would mean the regulations would apply during the election
Even if that doesn’t happen I can imagine the MAGA election officials treating this as if it had been decided in their favor and just ignore what the judge said, confident that Trump’s tame judiciary will shield them from repercussions.
Of course for any of this to matter, Harris would need to me leading in Georgia which as the polls stand would mean a significant swing in her favor. So she’d be winning handily even without Georgia. Still it would be momentously dark day for US democracy if the GOP manage to disenfranchise all of Georgia even if it doesn’t win them the election
I mean, of course they can, but it’s not going to change what actually happens in the elections. It’s not a legislative or law enforcement body. It can set rules, but if those rules are struck down then that’s about the extent of their authority.
They also have the authority to investigate and temporarily suspend elections directors, so in theory they could threaten that if their new “rule” isn’t followed, but that would have the effect of completely stopping the election altogether in the state and I have a feeling that just wouldn’t work.
Here is an article that provides some information about what the board does and can do:
And the Georgia supreme court said “nah” too

So I guess it goes to SCOTUS probably not until after the election though?
