[hijacky kinda of my own thread] FYI for the fans: I’ve been reviewing the transcripts as I prepare my brief and the judge, who is absolutely not happy with me, still gave me a real acknowledgement in the same breath she was telling me I blew it…but the fact she said it at all was nice, and nice to hear from a legal professional who isn’t on my side at all. (Bleh…reporter’s transcripts are in some weird all caps ASCII format that drives me crazy, that’s why the all caps) I have always fumbled around the whole ex parte process, which I think of as “Here’s my zippy request for you to hear my request zippily!” And, for those keeping score: it took 9 months, two ex parte hearings, two completely separate actions filed by the receiver, a separate action filed by me, a judicial disqualification, and a whole trial, but finally, in the last version of the most recent judgment, after spending a whole page describing exactly the ways in which the receiver could ask for contempt if I was a pain about selling the house, she gave me what I was fighting for not only for me, but really for all the other people the receiver has screwed or would try to screw later, in the following simple sentence: “While Defendant remains a tenant in common in the property _ **unlawful detainer is not the proper remedy** _.” and a cite to one of the many cases I had cited to her many months before. If she’d been speaking aloud it would have been mumbled under her breath. It’s certainly possible that I’m crazy. But I’m not wrong. ---

The UD thing is an excellent demonstration of why I didn’t, and why I’m incredibly glad I didn’t, and why there’s no reason I should have…except that it’s what was expected, even by my supporters, who are proud and happy and impressed as hell by me. And my detractors and opponents are ready to throttle me for the same things that impress those who support me… .I was supposed to give up when I ran out of money to pay lawyers, dammit! That’s what everyone does! What the fuck was I doing, fighting on? Didn’t I know that the person who can pay the biggest, baddest lawyers for the longest time is supposed to win? Oh well!🆒 ---
