Is it perjury or what?

I was referring to federal ALJs, under the APA. In addition to the above requirements, they have to complete a lengthy questionnaire and submit to an exhaustive interview.

I am not, however, familiar with Tax Court, and the nomenclature (“administrative court judge”) may be correct there, since that is a type of court, as I understand it, and probably is governed by a different set of rules.

Possibly a dumb question, but what the hey. If one or more defense witnesses are refused permission to testify because they refuse to swear or affirm, is there any sort of precedent as to when that interferes with the defendant’s right to present a defense?
