Legal Advice..PLEASE a.s.a.p

In defence of the OP, Sassy, as I mentioned earlier (if you actually read this thread) a command start has safety device that kill the ignition if the vehicle is attempted to be moved without the keys in the ignition. Thats the way they work…he had every reason to believe his car was as safe running as your is not, so put that attitude back until you know what the fuck your talking about. On the other hand, he should have called the cops ASAP.

IF the said "command start feature were being used, and he had to have KEYS to move the vehicle, then how the fuck did the vehicle get “stolen” as he claimed, unless there were no keys in the ignition. PRETTY FREAKING STUPID!!! As for you and your ill-fated attacks on my intellegence, I refuse to have a battle of wits with an obviously unarmed opponent. Why don’t you try reading the entire thread yourself, so you will know what the hell YOU are talking about before you go voicing opinions that don’t make sense!

Let me put it in simpler terms for you:
OP claims his car was stolen…OP claims he used remote start command, but had to use ignition key to turn on the heat…OP claims that he “took the ignition key off the ring”–so he could lock the door, but doesn’t exactly remember for sure if he locked the door or not–and leaves the ignition key in the ignition…OP returns to BAR for “last call”…OP comes out of bar and finds car is supposedly missing.
Now, if you read that and remember what YOU SAID that a command start was, then you are probably to the point of reasoning that this person had to leave a key in the ignition for someone else to “steal” it!
I know what I am talking about–DO YOU, MORON???

SASSY

Locked, running car stolen twice.

zgystardst,

interesting article. I especially liked this part:

No freaking way! You sure you wanna do something that drastic?

I love the word “coincidently” in

Um no. A coincidence is having two seperate gangs of pit bulls sodomize you within an hour of each other. When you leave your car running in a populated place for an extended period of time…TWICE…that’s stupidity.

Not that I’d want to relate that to the OP in any way…

Uh, sassyKYredhead, are you going to take after me next? Now that the temperature is hovering around zero I take my spare key down to my car and let the engine run for a while before I go to work, then come back up to my apartment while I wait for the beast to warm up. Would I do that in Minneapolis? Heck, no - but in the small town I live in people DO things like that, so just chill a little about how stupid you think shangois, will you please?

bernse, thank you for your explanation of the command start. Those must have occurred in the past 12 years or so, because I don’t remember ever seeing any in my days in Idaho. (Now in Southern California where the word “snow” is verboten).

Is that personal insults I see in the General Questions forum? Oh, the humanity! I must be mistaken.

Why doesn’t everyone go run outside naked in the snow to cool down, and then shake hands with a smile to appease Chronos and manhattan. Then you if you really want to, you can hustle on over to The BBQ Pit and continue your fight behind their backs.

SassyKYRedhead, allow me to elaborate on what my fellow moderator said. Personal insults are not allowed in this forum, under any circumstances. If you want to tell another poster that he or she is wrong, then you should feel free to say so, provided that you can say so in a polite manner. You do not call other posters “moron”, “witless”, or “pretty freaking stupid”.
You’re getting off to a very bad start here, it seems. We will not put up with this misbehavior indefinitely. Consider this an official warning.

I am truly remorseful for having offended the moderators. But, you have to admit that it was pretty stupid to leave your car running outside a bar at closing time! (I wasn’t calling any person stupid, just now…only an action!)

Ok, so the moron crack was uncalled for, and I apologise to the person it was intended for!
Chronos, Consider my hands slapped!:()

Sassy

P.S. to Chique: no, I’m not going to jump all over you. You were at your home, in a neigborhood you knew with a somewhat watchful eye on your vehicle. (Meaning you didn’t start it and then go back inside to slam down a couple cold ones!) I live in the country, and in the winter will often start my car and let it warm up first, but not in the middle of a seedy neighborhood on the other side of town across from a bar!

Hello,

Well I got replys alright.
Thanks to all that added their input.

I talked to legal aid Wednesday, she wants me to take ICBC to court. She’s says there just trying to get out of paying for the damages.

I did tell her though that the investagator did have some good points.

  1. why start the truck without the command start?
…its not programed properly. By that I mean I cant have my key in the ignition and turn it in the off position and still have the truck run. when its programed correctly you can do this.

  2. Why not phone the police?
… I’ve got jerk s for friends,we all thought someone was playin a joke so we looked for it…some joke.

What I was told to do is ask for access to information file.
Also ask the police if they have any suspects or finger prints. Also to take photos of my truck with the damages.(for my own evedience)

Drinking and driving is wrong. 2beers at 11:30-12:00roughly.

Had no more, started the truck around2:15am.

thanks again

Two questions:

  1. When you refer to your “spare key”, does that mean you the car is locked while it’s warming up, and then you open it with your main key? I sure hope so.

  2. Even with locking the doors, such actions would be pretty reckless here in New Jersey, where it only takes 3-5 minutes to warm up, and you can sit in it for that short a time. How long does it take in your area?

I used to have a housework customer–I’ll call her Cora–who knew I was taking legal courses. She called me one day and asked, If a car is stolen while in the care of a mechanic–in this case an Aamco shop–is the shop liable?
At the local law library, I pored over some volumes of California statutes and case law–I assumed later on an attorney’s assistance might be in order for Cora’s situation (her sister’s car was involved). I called her and told her I had found this and that in some California law volumes that would seem to indicate that, yes, the shop would be liable.
She told me that since she first called me, she found out that an Aamco mechanic had parked the car illegally and the police had it towed to an impound garage!!
To make a long story short, Aamco was very nice about it; they paid the fees. (I wonder what they did to the mechanic…)

As someone who lives in a “Northern Area,” I can say that what the OP describes is fairly common. You use the command start or a spare key to start the car, lock it (if you’re using the key; with a command start you don’t even get in the car - think garage door opener), and then wait a while for it to warm up, while you stay inside. For how long? Depends on where you are and how cold it is. In my area, we’ve just gone through a cold snap of -30 Celsius every morning for a week, so staying inside for 5 or 10 minutes isn’t unusual.

That said, if I was doing it at a bar after midnight, with a key, I’d probably stand inside the door and watch it. But, as noted, command starts are programmed to kick out if you try to move it without a key, so the actions described in the OP aren’t that unusual.

In fact, one time my brother and I were driving home in -30 weather with an old car that was an unreliable starter. We stopped at an A&W, left it running with his keys, locked it with mine, and went inside to eat - it ran unattended for 30-45 minutes while we ate. Up here, OP’s conduct is not that unusual.
