Making a porno, legal questions (clean)

So guano, were you involved with the industry?

My friend is insisting on filming tonight, even tho I told him I don’t have all the forms yet. Heres what I found:

I’m sure the hampsters are going to tear that to shreds, but you get the point.

Another problem is that my friend tells me the 2 “acctresses” that are interested in doing this MIGHT be coming tonight. We’ll see what happens rolleyes

God save me from straight lines.

What? I don’t get it Euty…

Yes, I am involved in the industry, in a small way. Our release forms etc are several pages long of legalspeak, utilising a combination of Australian and US law (they’re photographed and filmed here, but released worldwide, the movies distributed via a US company).

I am not the main person behind it, though, so I have limited knowledge.

Hiya

GuanoLad and I work together, and I wrote our forms (then got them approved by my lawyer). We regularly produce explicit adult video and still image content. There are several threads I have posted to regarding legalities and stuff, here on the SDMB, so you might want to look them up.

Your friend sounds like a bit of a cowboy in this - getting into producing porn with a legal consult, and lots of forethought, is just crazy, IMO. And his schedule is what, four days?

As an absolute bare minimum, there are a few things to be aware of.

Each model needs to be tested for STD’s. Required blood tests are for:
HIV
RPR / TPHA / TPPA (Syphilis)
HEP B
HEP C

Required tests from a vaginal swab (or urine sample) are:
Neisseria Gonorrhoeae
Chlamydia trachomatis DNA
Herpes Simplex (if lesions present)

As the producer, your buddy would want to have the results on paper, before shooting begins.

Next, you’d want to be sure that what you are doing is legal in your state (some states, is it most definitely not).

Next you’d want a release form that the models sign. The one you cited above is weak, and I’d recommend against using it. Anyway, if a model wants blood from your bud at a later date, all the signed paper in the world is not going to stop it being a major headache (trust me). Better to speak to the models straight up and honestly, and warn them of the dangers.

What will they do if their SO / parents / priest finds out what they have done? Does he really want to ruin someone’s life?

Next up, ID. Most western countries are (rightfully) VERY ANAL about ID. 18 U.S.C. § 2257 Compliance regards having proper proof of age for models. That means government issued (Passport, drivers license), not a library card, ya know?

There are a million more details, and I’d highly recommend against shooting ANYTHING until s/he has spoken to a lawyer, and done a hell of a lot more research than asked his mate to ask on the SDMB. I think he’s being irresponsible, and the industry has a bad enough name as it is.

abby

I’ll Throw in with abby’s coments here. He needs to do alot more preperation. I’m working on getting into the Biz, but I’m nowhere near ready to start shooting, yet. I’m still learning the basics, like legality, and camera work, etc. I’ve had some great help and advice (thanks again abby). But I’m still way off from shooting my first feature. May be kinda close ( a month or two) to posting my first adult website. But the devil is in the details, and we’ll just see how it goes.

If, on the other hand, he’s just shooting private home movies he may be ok. If he’s very careful not to share. That’s when he’s in loads of legal trouble.

We’ll the girls never showed up on Friday but on Saturday they somehow got some strippers to come over. All they filmed was a couple hours of strip poker…he plans on trying again next weekend.

I am planning on asking a friend of mine for some help on the legal stuff of this. She’s been working as a paralegal for a couple years.
