I think I was confused more by the way the judge’s ruling referred to a “protected system” and assumed it was like here, where there is a legislated requirement to protect the data if collecting personal information is part of your routine operations (where video footage is included as “collecting”). I thought if the laws were the similar, then the mall has a duty to safeguard footage, whereas in the cop’s case, the footage belonged to a private individual. Ignorance fought. ---
