If he’s specifically trying to buy her silence, during the campaign, isn’t that an campaign expense that needs to be reported?
Of course, he could report it as “publicity management” or some such vague but broad enough title.
Of course, that would assume he cares about complying with the law ….

Well, yes, and that is _exactly_ what he was found guilty of having done, with regards to Daniels, in 2016. But, just making the offer this time, assuming that Daniels turned it down, wouldn’t be.

Yeah, he was convicted of falsely reporting actual payments he made, IANAL but I think having intent to do that isn’t a crime itself if the payments never happen. Even then you’d need to prove that he intended to not report it correctly. It’s almost like pre-crime from _Minority Report_.

Merchan was to have issued a ruling on how Trump’s immunity affects the Stormy Daniels case on November 12, ahead of sentencing on November 26. He’s now rescheduled the immunity decision to November 19:

Does it matter any more?
No matter what the judge does, Trump will undo it on January 20.
(and yes, I know that in theory, the constitution says a president can only issue a pardon on a federal case, not a state case. But Trump doesn’t care, 52 Senators don’t care, and the Supreme court doesn’t care. )

Jail him until the inauguration - just kidding. Seriously, make the convictions have some meaning even if the judges suspends the incarceration. Put the stain on Trump for all history. Trump will flail, appeal, rant. Let him. Keep gnawing at him.

Give him 4 years home confinement. He can sit in the White House being President, but can’t leave. Sentence to begin immediately after he is sworn in, and to end on the final day of his term.

It sucks that the prosecutors agree with the defense to delay sentencing until Trump’s term is over. Apparently that’s their motion according to NBC news right now.
