# Missouri Supreme Court Throws Out Trump-Led Redistricting

But wait, there’s moie! A few minutes after SCOTUS announced they wouldn’t hear the appeal, a U.S. District Court judge upheld a different Republican lawsuit and ordered the state to use the 2025 maps.
The group opposed to the Trump redistrcting immediately responded that a U.S. District Court does not have the authority to overturn a state supreme court ruling - only SCOTUS can do that.
Now there are two opposing rulings from Federal courts. Naturally, the Missouri Attorney General is directing the Secretary of State to abide by the District Court ruling and ignore SCOTUS.
And everyone is going back to court. The deadline for mailing ballots to overseas military is September 18.

The case is going back to SCOTUS, bypassing the normal process of being heard by the Court of Appeals. This is getting too complicated for me to explain, so here’s a (hopefully free) link.

What I don’t get, and what that article fails to explain, is how does a Federal District Court get the authority to override the State Supreme Court and an order from a Justice of SCOTUS to enforce the decision by the State Supremes??? Really not getting how this happens.

They’ll probably (hopefully) get shot down by SCOTUS, but in the meantime, more time passes, more confusion reigns, and maybe the GOP says it’s too late to change now. I mean, there’s nothing stopping them from ruling how they want for now, right?

By ruling in the suit in front of them and using slightly different language to make it seem like they aren’t expressly contradicting the MO Supreme Court.
The MO Supreme Court basically said - “you can’t use the HB1 maps because they aren’t law yet due to the citizen petition”
The Federal Court Judge said - “not using the HB1 maps would violate the rights of voters that voted in primaries using those maps so you can’t use any maps other than those”
The 8th Circuit denied the request to lift that federal court ruling. So the citizen group appealed to SCOTUS to (hopefully) point out that in election law state supreme courts trump Federal courts.
The MO Supreme Court has issued multiple rulings to local election authorities demanding they not use the HB1 maps. The MO AG has ordered the opposite.

That looks correct. Kavanaugh issued a stay of the TRO that was ordered by the federal court that prohibited the state from using the old maps. So now they are free (in fact, required) to use the old maps as the MO Supreme Court ordered.
Timely, in that they are appearing before the MO Supreme Court right now to explain why they aren’t complying with said order.

Yeah, I heard Hoskins was supposed to appear before the MO Supreme Court today and explain why he shouldn’t be held in contempt. I heard he was also supposed to file some brief before his appearance today and blew it off. So here’s hoping the hammer comes down hard, but I ain’t holding my breath.

He blew it off, and Republican legislators are threatening to impeach any judge who holds him in contempt.
It turns out that he’s not an attorney (he’s an accountant), so disbarment isn’t on the table. But I wonder, if he _were_ an attorney: could so eggregiously violating an order from a State Supreme Court(!) end in disbarment for an attorney who tried it?

Then the courts should threaten any lawmaker with contempt of court if they impeach a judge for holding Hoskins in contempt.

Hoskins has agreed to direct local elections officials to use the 2022 maps. He is due back in court in 15 minutes or so to explain himself. The MO Supreme Court was rather unimpressed with his lawyer’s hemming and hawing this morning.

It may not be. The order SCOTUS rejected this morning was made by a Federal District Court judge. SCOTUS rejected it on the grounds that the order should have been stayed until the 8th Circuit Court of Appeals ruled on it.
The lead plaintiffs in this lawsuit are Republican candidates for two of the newly drawn districts. They might decide to drop the lawsuit, or they may go ahead and roll their dice with the Appeals court. Whoever wins that appeal, the loser will certainly appeal to SCOTUS. The big difference will be that ballots will already be mailed out to military and overseas voters.

The Court’s position appears to be that federal courts may decide cases about racially motivated redistricting, but not politically motivated redistricting, and that the two can be distinguished.
