Firstly, there’s nothing in the 8th amendment that talks about conviction, guilty, or prisoner.

As to your second point, we have a [whole thread](https://boards.straightdope.com/t/controversial-encounters-between-law-enforcement-and-civilians-the-omnibus-thread-2/912531) bitching about ugly cops. What do you suppose would happen if we came across some poor schlub in a fetal position? “The cows… he kept talking about the cows.”
